PAST LIVES, LLC
POLICIES, TERMS, AND CONDITIONS
Please review the following carefully and acknowledge that you have completely read and understand our terms and conditions.
EQUAL OPPORTUNITY POLICY
PAST LIVES does not discriminate on the basis of race, age, color, religion, national origin or ancestry, sex, gender, disability, veteran status, genetic information, sexual orientation, or gender identity or expression.
Unless otherwise specified, PAST LIVES classes are open to anyone 18+. Youth 16-17 may attend after a legal guardian has met with an PAST LIVES staff member and signed a liability waiver. Youth ages 10-15 may attend with an adult and a waiver signed by a legal guardian.
Each member of PAST LIVES shall be liable for any property damage to PAST LIVES and/or personal injury to other persons using the facilities caused by the member or the member’s guest. It shall be the obligation of the member to pay for any costs involved upon presentation of a statement thereof. If the entirety or any part of PAST LIVES equipment is damaged due to a PAST LIVES Member’s negligent actions, PAST LIVES reserves the right to bill said PAST LIVES Member the market price of the damaged equipment plus labor.
AUTOMATIC MEMBERSHIP RENEWAL
PAST LIVES bills members on a recurring basis each month on the day of the month membership was initiated. Members can cancel their own accounts online at PAST LIVES at any time. All membership cancellations must occur prior to the next bill date. It is the member’s responsibility to cancel their own membership before the next billing period.
MEMBERSHIP REFUND POLICY
PAST LIVES offers refunds if membership is cancelled within 5 days of the charge. After five days, PAST LIVES does not offer membership refunds except for specific events, such as disability or death. A 10% processing fee will be assessed for all membership refunds. Please send refund inquiries to email@example.com.
CLASS CANCELLATION POLICY
Please send refund or rescheduling requests to firstname.lastname@example.org.
Although we make best effort to accommodate any late-notice cancellations due to unforeseen circumstances, PAST LIVES is not responsible for giving refunds for classes, workshops, or other programming missed due to illness, emergencies, or events beyond our control with less than 72 hour notice. A $20 processing fee will be assessed for all cancelled or rescheduled individual class registrations.
PAST LIVES reserves the right to cancel programming at any time and will notify students via email and/or phone. In the case of a class cancellation, PAST LIVES will notify class takers no less than 24 hours before the scheduled class. In the rare event that a class is cancelled by PAST LIVES, a full refund will be provided. If a class should fail to meet minimum enrollment 5 days prior to the scheduled meeting, the class will be cancelled.
If a student misses a single class in a series or portion of a class, PAST LIVES and its instructors are not responsible for make-up sessions. Students should inform PAST LIVES as soon as they are aware of a session they will miss. In some cases the student may need to sign up for 1:1 instruction time in order to catch up.
CANCELLING DAYS OF BUILDING
Group programs must be canceled at least two weeks in advance in order to receive a full refund. There will be no refunds or transfers if the class is cancelled with less than two weeks notice or if there is a failure to attend. PAST LIVES reserves the right to cancel programming at any time and will notify students via email and/or phone. In the rare event of an PAST LIVES-initiated cancellation, a full refund or credit will be issued. A $20 processing fee will be applied to group class cancellations two weeks+ out unless it is rescheduled. This fee can be applied to future cost if rescheduling occurs within two weeks.
By signing this agreement, the individual consents that PAST LIVES has full and unrestricted publishing and use rights for any photographs or other media (digital or print, in any medium) taken on the PAST LIVES property by PAST LIVES employees or volunteers in which any image, materials or art, either brought into or created/generated at PAST LIVES, appears. Participants hereby release, discharge, and agree to hold harmless PAST LIVES from any liability by virtue of any blurring, distortion, alteration, optical illusion, or use in composite form whether intentional or otherwise, that may occur or be produced in the taking of said picture or in any subsequent processing thereof, as well as any publication thereof, including without limitation any claims for libel or invasion of privacy.
PAST LIVES does not allow any weapons on the premises. This includes weapons covered under a Concealed Weapons Permit.
Projects or materials may be left up to 72 hours at PAST LIVES with the permission of an PAST LIVES staff member providing they are stored in a location that is not hazardous or inconvenient and that is properly labeled with a full name, date it will be removed, and a phone number of the project owner.
Unlabeled items left on the premises for more than 48 hours outside of rented space or after membership expires will be removed. PAST LIVES makes a best effort to notify individuals before material/projects are seized. PAST LIVES is not responsible for any item left at PAST LIVES under any circumstance. Longer-term project storage may be available upon request and subject to availability and additional fee. Contact email@example.com to request longer-term project storage.
RIGHT TO REGULATE USE OF PROPERTY
PAST LIVES shall have the right to make such rules, regulations, and restrictions in the use of all or any part of the property as it may deem necessary or appropriate. Such rules, regulations, and restrictions shall be known as Shop Rules. Shop Rules shall apply to all members and their guests, and all other visitors (family members, clients, etc.). PAST LIVES may modify, amend, or revise the Shop Rules in whole or in part at any time.
PAST LIVES facilities and services may be unavailable during a period of repair and maintenance or special events, programs, private events, or by Management’s schedule for these events. In order to keep the facility in the best possible condition, PAST LIVES in its entirety or in part may be closed for a temporary time period for repairs and renovations. There will be no adjustment in dues for this period of closure.
All Members must use their own access code to enter the building, once provided. Access codes must not be shared or made available to anyone other than the assigned Member. If an access code is lost, misplaced, stolen, or compromised, the Member must notify PAST LIVES immediately. All PAST LIVES guests and visitors must complete a Visitor Release and Waiver of Liability form and must be accompanied by a Member or staff member at all times. Guests and visitors may not use any equipment without completing a safety orientation, and must follow all Shop Rules and safety procedures.
PAST LIVES does not provide workshop access for production scale fabrication absent separate written authorization. At the discretion of PAST LIVES and its staff, any members viewed as doing large scale production work that uses resources above and beyond membership dues in any of the PAST LIVES shops will be notified to stop production, and membership will be cancelled and any associated fees relating to production may be charged to said member’s account.
All guests must be preapproved by PAST LIVES and must complete a Visitor Release and Waiver of Liability form before entering the shop. PAST LIVES reserves the right to withhold approval of guest access for any reason. All guests must be accompanied by either an active member or staff member. Guests are not permitted to use any tools or equipment within the facility without an active membership and without first completing a New Member Orientation. Members shall be responsible for the conduct of their guest, who shall be subject to these Terms and Conditions and all revisions and changes of such.
PAST LIVES does not permit and will not tolerate any inappropriate conduct. Such conduct includes, without limitation, using abusive, offensive, insulting, demeaning language, profanity, unnecessarily loud language, lewd conduct or any conduct that harasses or is bothersome to members, guests, or PAST LIVES employees. For purposes of clarity and without limitation, any interaction within the PAST LIVES space is subject to the consent of all participants. PAST LIVES reserves the exclusive right to immediately terminate membership and permanently ban from the building any person, whether or not a member, upon receipt of a conduct complaint, whether or not such complaint has been independently verified or otherwise.
VIOLATION OF POLICIES OR RULES
If any member or guest violates any of the PAST LIVES Policies, PAST LIVES may require that person to stop work and leave. A member’s violation of any of the Policies may also cause PAST LIVES, in its sole discretion, to terminate that person’s membership and/or other agreements without right to a refund.
SUSPENSION/TERMINATION OF MEMBERSHIP BY MANAGEMENT
Management has the right to suspend and/or terminate any membership for non-payment of dues, fees, or for behavior detrimental to the experience of other members or staff for any reason deemed sufficient in the sole discretion of Management.
NO JOINT VENTURE OR REPRESENTATION
Membership in PAST LIVES does not constitute a joint venture, partnership, nor other ongoing business interest between the Member and Past Lives, LLC, nor does membership grant a Member authority to act as an agent or representative of Past Lives, LLC, its subsidiaries, affiliates, or assigns.
Any member, guest, or other person who in any manner makes use of or accepts the use of any tools, equipment, facility, privilege, or service whatsoever owned, operated or made available by or through PAST LIVES, or who engages in any event or other activity operated or organized, arranged or sponsored by PAST LIVES, either on or off of PAST LIVES’s premises, shall do so at his or her own risk, and shall hold PAST LIVES, its owners, employees, representatives, and agents harmless from any and all loss, cost, claim, injury, damage, and all liability, sustained or incurred by him or her resulting therefrom, and/or resulting from any act of any owner, employee, representative or agent of PAST LIVES. The undersigned acknowledges that access to the shop includes access to inherently dangerous equipment and situations. All persons entering spaces operated or controlled by PAST LIVES are required to successfully complete a New Member Orientation prior to working in the shop in any capacity.
